Andrew Breitbart has found what he thinks is a smoking gun to attack Elena Kagan — he can’t use legitimate criticisms of her because they come from the left, not the right — in a video of a 1997 speech where she says of the Robert Bork confirmation hearings:
“And I, like Professor Toulouse, I loved what happened in the Bork hearings. I wrote a review of Stephen Carter’s book recently where I said, “no, he has it all wrong. The Bork hearings were great, the Bork hearings were educational. The Bork hearings were the best thing that ever happened to Constitutional Democracy.” So, I share that view with Professor Toulouse.”
I do too. The Bork hearings revealed just what a horrible justice he would make and he therefore lost the vote. Perfect ending. But it’s a little late to win me over at this point.
