Dispatches from the Creation Wars

I reported a few months ago on a 5th Circuit Court of Appeals ruling that denied qualified immunity to two elementary school principals who denied students the right to hand out religious literature in their schools. Now the full appeals court has granted a request for an en banc rehearing on the matter.

I expect they will overturn the immunity ruling. The courts seem to have a fetish for protecting government agents from civil suits after they abuse their authority, from teachers to police officers to — most of all — prosecutors.
