While I think the brief is despicable, all this talk about it comparing gay marriage to incest and pedophilia is at best misleading and at worst dishonest.
The argument the brief is making is, as I understand it:
States have been allowed to not recognize legal marriages from other States if those marriages go against that State’s public policy.
Examples of this are things like how old you were when you were married or how close of a relative your spouse is.
What gender combinations can marry is the same type of public policy issue and so the same rules should apply.I don’t know about the legal validity of the argument but to suggest that it says that gay marriage is the moral equivalent of either incest or pedophilia is just wrong. The brief is plenty reprehensible by itself. We don’t need to lower ourselves by making up stuff.
