The patent appeals panel ruled that the existence of horny goat weed, a traditional Chinese medicine used orally for impotence, was grounds for rejection of the claim.</p> <p>Frequent commenter daedalus4u pulled out <a href="http://www.google.com/patents?id=XugKAAAAEBAJ&amp;printsec=claims&amp;zoom=4#v=onepage&amp;q=&amp;f=false"><strong>US Patent #6,469,012</strong></a> (filed Mar 4 1996, issued Oct 22 2002) wherein the relevant claim 24 reads:</p> <blockquote><p>A method of treating erectile dysfunction in a male human, comprising orally administering to a male human in need of such treatment an effective amount of a selective cGMP PDE inhibitor, or a pharmaceutically acceptable salt thereof, of a pharmaceutical composition containing either entity.</p></blockquote> <p>The claim should never have been allowed in the first place, said daedalus4u, and if upheld would have allowed Pfizer to block sales of horny goat weed. I'm also assuming that upholding claim 24 would have also allowed Pfizer to block sales of follow-on PDE5 inhibitors such as Lilly's Cialis<sup>®</sup>. But again, I'm not a patent attorney so I welcome further discussion on this point.</p> <p>We also heard from my dear old colleague from Adelaide, Professor Ian Musgave. Ian is a pharmacologist who is probably better known in the blogosphere for his astronomy expertise (<a href="http://astroblogger.blogspot.com/"><strong>Astroblog</strong></a>, <a href="http://home.mira.net/~reynella/skywatch/ssky.htm"><strong>Southern Sky Watch</strong></a>, and contributing editor to <a href="http://www.skyandspace.com.au/public/home.ehtml"><strong>Sky &amp; Space</strong></a>). </p> <p>But Ian is first and foremost a pharmacologist and raised this point:</p> <blockquote><p>Wait a minute, let me get this straight. The patent on Sildenafil, a compound that was rationally designed to specifically inhibit PDE (1) and developed prior to <b>1996</b> was invalidated because of a structurally unrelated component of a herbal extract <b> that wasn't even shown to act on the cGMP/NO system before <em>2001</em><b>? (2)</b></b></p> <p>Pfizer is supposed to have time travel? The fact that a herbal treatment alleged to help sexual function would turn out, 5 years <b>after</b> the sildenafil patent had been granted (and the concept of PDE5 inhibitors as treatment for erectile dysfunction wide spread) to have effects on PDE5 could not possibly count as prior art. If so, the 1983 demonstration that the <a href="http://scienceblogs.com/denialism/2007/10/the_road_to_sildenafil_a_histo.php" rel="nofollow">PDE inhibitor papaverine could produce erections</a> would have invalidated the sildenafil patent.</p> <p>The patent boards ruling is patently rubbish. How can sildenafil "logically flow" from a compound that wasn't even known to really work, let alone known to inhibit PDE?</p> <p>(1)Nicholas K. Terrett, Andrew S. Bell, David Brown and Peter Ellis. Chin Sci Bulle 2001; 46: 485-9.</p> </blockquote> <p>Prof Musgrave is indeed correct in the argument but daedalus4u points out the ruling did not invalidate the Pfizer patent, just the single claim to the pharmaceutical indication.</p> <p>So that makes more sense to me and now I think I understand.</p> <p>But in the discussion, Ian gave us another gem in response to a commenter who <a href="http://scienceblogs.com/terrasig/2010/02/viagra_horny_goat_weed.php#comment-2286064"><strong>argued</strong></a> there was a structural resemblance between sildenafil and icariin, the active flavonol glycoside constituent of horny goat weed:</p> <blockquote><p>No, not at all. You can stick the benzofuran of the flavonol on top of the methylxanthine moiety of the sildenafil, but the charge distribution and 3D structure is all wrong, the flavonol has these huge sugar moieties which have the wrong charge and stick out in places that should inhibit binding, it lacks the bulky positively charged ring that fits into the PDE5 specific binding pocket. (I have the an image of the 3D structural overlay if anyone want to see them).</p> <p>Looking at it, icariin does not scream either methylxanthine mimetic or "PDE inhibitor", in fact I would guess it would be worthless. However, flavonols and flavinoids have a habit of doing things we don't expect, such as resveratrol being a very decent cannaboid receptor anatgonist, despite looking nothing like cannabinoids of the synthetic antagonists. </p></blockquote> <p>In fact, Ian was kind enough to send us two molecular modeling images of the two compounds which I failed to get posted last night that illustrate the vast difference between sildenafil and icariin. One doesn't need to be a computational chemist to see from Ian's overlay why this difference in potency and efficacy exists.</p> <p>Anyway, this has been an interesting scientific exchange on an issue that was largely only covered in the pharmaceutical business press. But Yohimbine, the active ingredient of Yohimbe, acts in a completely different manner (it's an alpha-adrenoceptor blocker).</p> <p>The point is that clause 24 is a clause about selective cGMP PDE inhibitors, not "anything that can treat erectile dysfunction in anyway imaginable". You can quite legitimately say clause 24 is too broad (but Pfizer hasn't stomped on any other selective cGMP inhibitors like tadalafil or vardenafil etc.). The term is called "crapping on the art". </p> <p>In order to "crap" on the patent art, you don't need peer-reviewed stuff, you don't even need stuff that is accurate or even correct. Horny goat weed doesn't even need to work to treat erectile dysfunction, so long as it is believed to work, and is used for that indication, and is in use prior to the filing of the viagra patent application, and contains a selective phosphodiesterase inhibitor, then it counts and the claim must be rejected. </p> <p>The mechanism of its function does not need to be known before the viagra patent filing, just that it is in use. </p> <p>There are some real weaknesses and loopholes in patent law. One of them, that by demonstrating a single case you get to claim all cases is (I think) very damaging. The patent appeals panel ruled that the method did not constitute a new invention because of the precedent set by Yin Yang Huo. Moreover, the board ruled that chemicals found in the herbal medicine act by the same mechanism as sildenafil by inhibition of an enzyme called phosphodiesterase-5 (PDE5). Therefore, the panel ruled, "the patent claim was the next logical step up from using the herb."</p> <p>I'm not an expert in law but there are untold number of traditional remedies touted for all sorts of sexual enhancement, none of which have the convincing efficacy of the prescription PDE5 inhibitors. We may call the condition "erectile dysfunction" today and the idea of treating it may have existed for centuries but having a compound that can actually do anything about it is an invention. However, I can see the fine distinction if Pfizer claimed that the <em>idea</em> of treating erectile dysfunction was an invention.</p> <p>You lawyers out there can weigh in but this sounds like a bunch of posturing for market share: worldwide Viagra sales were $2 billion USD last year.</p> <p>But what is this horny goat weed and why is it being singled out?</p> <!--more--><p>Horny goat weed is the colloquial name for any number of species of plants in the <em>Epimedium</em> genus. Most medicinal plant accounts describe some variation on the theme that a Chinese goat herder observed an increase in mating behavior among his flock while grazing on the plant. According to North Carolina State University Department of Horticulture <a href="http://www.ces.ncsu.edu/depts/hort/consumer/factsheets/groundcover/epimedium_spp.html"><strong>webpage</strong></a>, it grows as a deciduous perennial ground cover in USDA Zones 6, 7, and 8.</p> <p><a href="http://scienceblogs.com/terrasig/Icariin%20and%20sildenafil.gif"><img alt="Icariin and sildenafil.gif" src="http://scienceblogs.com/terrasig/assets_c/2010/02/Icariin and sildenafil-thumb-300x143-41241.gif" width="300" height="143" class="mt-image-left" style="float: left; margin: 0 20px 20px 0;" /></a>The active compound in horny goat weed is a flavonol called icariin. As shown above, icariin (left) is about as can be from sildenafil (right). Moreover, icariin is a poor inhibitor of PDE5, with a IC50 value of 5.9 μM, making it about 80-fold less potent than sildenafil (IC50 = 75 nM) <a href="http://www.ncbi.nlm.nih.gov/pubmed/18778098"><strong>(<em>J Nat Prod</em> 2008; 71:1513-1517.)</strong></a></p> <p>And remember: that's the purified compound in an isolated enzyme assay. Let's take a look at the plant extract itself, the product sold on the internet and in health food stores as horny goat weed.</p> <p><a href="http://scienceblogs.com/terrasig/Horny%20Goat%20Weed%20Fig%204%20Int%20J%20Impot%20Res.jpg"><img alt="Horny Goat Weed Fig 4 Int J Impot Res.jpg" src="http://scienceblogs.com/terrasig/assets_c/2010/02/Horny Goat Weed Fig 4 Int J Impot Res-thumb-300x369-41243.jpg" width="300" height="369" class="mt-image-right" style="float: right; margin: 0 0 20px 20px;" /></a>This figure comes from a <a href="http://www.ncbi.nlm.nih.gov/pubmed/16395327"><strong>2006 paper</strong></a> in the <em>International Journal of Impotence Research</em> (2006; 18:335-342) where an extract of a specifically-selected Epimedium plant was extracted and partially purified, then tested relative to sildenafil in a tissue preparation of rabbit corpus cavernosum (the crucial penile vasculature). The extract, EP-20 was tested here for its ability to increase the levels of the second-messenger molecule cGMP in response to the nitric oxide donor, sodium nitroprusside (SNP). Erectile dysfunction agents acts to inhibit the degradation of cGMP, causing the corpus cavernosum to relax and increase blood flow to the penis.</p> <p>The EP-20 extract does indeed increase SNP-stimulated cGMP concentration over SNP alone, but it tops out at about 1/10 the levels stimulated by sildenafil (note the broken y-axis for scale). More importantly, the concentrations of horny goat weed extract are tremendously high: 0.1 and 0.3 mg/mL. A direct comparison with sildenafil is difficult because it is a pure compound while the EP-20 horny goat weed extract is a mixture of all the chemicals that occur in the plant.</p> <p>The take-home messages?:</p> <ul> <li>The active constituent of horny goat weed, icariin, bears no structural similarity to sildenafil.</li> <li>Sildenafil is 80 times more potent than icariin in inhibiting phosphodiesterase-5</li> <li>Horny goat weed extract must be used at unbelievably high concentrations - far more than can be achieved in the bloodstream - to cause only 1/10th the effectiveness of sildenafil in a rabbit penile blood vessel model.</li> </ul> <p>So, horny goat weed is far from stiff competition for a prescription PDE5 inhibitor like sildenafil. Yes, it has the potential to target an animal model of penile vasculature in a manner similar to sildenafil but it is unlikely to occur in a real-life scenario. However, there have been no head-to-head clinical trials of horny goat weed extract and sildenafil.</p> <p>Going back to the Pfizer and Eli Lilly spat, there is really little comparison between horny goat weed and the active compound in Viagra.</p> <p>And as for anyone thinking that horny goat weed might be a more cost-effective substitution for Viagra? Horny goat weed is covered by claim 24. </p> <p>If claim 24 was upheld, then Pfizer could start demanding royalties from people selling horny goat weed, even people that have been growing and selling horny goat weed for centuries. </p> <p>I appreciate that Pfizer isn't trying to get royalties from horny goat weed, but from other pharma companies that are selling synthetic PDE5 inhibitors that are different than sildenafil. I appreciate that blocking other pharma companies from doing that is worth billions to Pfizer. But Yohimbine, the active ingredient of Yohimbe, acts in a completely different manner (it's an alpha-adrenoceptor blocker).</p> <p>The point is that clause 24 is a clause about selective cGMP PDE inhibitors, not "anything that can treat erectile dysfunction in anyway imaginable". You can quite legitimately say clause 24 is too broad (but Pfizer hasn't stomped on any other selective cGMP inhibitors like tadalafil or vardenafil etc.). A patent with an invalid claim is more valuable even if that claim is never tested than a patent with a claim that has been invalidated. </p> <p>The news report does seem to indicate that it was Pfizer that brought the suit. <i> âThe claims came under contention as part of a patent infringement lawsuit Pfizer filed against Eli Lilly and Co, which makes the rival drug Cialis.â</i> </p> <p>Some companies (probably most) might decide that even when they are very sure that claim 24 is invalid, that the business risk of suing to have it invalidated isn't worth it. Pfizer has deep pockets. They could spend tens of millions defending a bogus patent claim and never miss it. It still becomes a crap shoot as to how a judge will rule, a judge who may not understand the science that well. </p> <p>A company could sell a PDE ID drug and be confident that because claim 24 is invalid that if Pfizer sues them, that claim 24 will be ruled invalid and they will be vindicated. If they guess wrong, and claim 24 is ruled valid, then they are liable for triple damages. </p> <p>I think the lawsuit isn't really about issues of law. They are very clear cut in this case. I think it is about spin and how the spin affects the stock prices and drug sales. I would expect that both Viagra and Cialis had increased sales from the publicity due to this lawsuit. </p> <p>Blake, I don't think this does inhibit using natural products as source material for developing new drugs. It does inhibit patenting natural products that have been in use for many years. Patenting is only to protect inventions, which are by definition something that has not been done before. The FDA has issued multiple alerts about these contaminated dietary supplements. </p> <p>Consumers and health care professionals should be aware of this problem and the health hazard it presents. Sexual enhancement products that claim to work as well as prescription products are likely to contain a contaminant. Use of such products exposes consumers to unpredictable risk and the potential for injury or even death.</p> <p>In the case of Stiff Nights, following a consumer complaint, the FDA determined that the product contains sulfoaildenafil. This is a chemical similar to sildenafil, the active ingredient in Viagra. I have a company in Canada, it is an actual site licensed approved company that distributes herbs.</p> <p>I can tell you as a fact that this product contains Viagra and I can also show you where the company actually tells you it contains Viagra.</p> <p>These spiked product exist primarily in the US, as a Canadian company, we see these pop up regularly and they are a source of both aggravation as well as being a source of mininformation, which we find even more damaging.</p> <p>As a clean company, producing clean product it is very hard for us to abid by NHP regulation in not producing marketing and advertising to jump on the money bandwagon is it is and instead play it very quite, meanwhile completley unscrupulous operations in the US go about poisoning for riches.</p> <p>This company and all other like them have one clear signal they print on all their packages of 'herbal' products containing pharma-drugs.</p> <p>"Do not take more than one pill per 36 hours".</p> <p>Any sort of caution like this found on any 'herbal' product in fact tells you it is spiked. </p> <p>There is no herb formula that is a clean product that one has to be concerned about taking too much (ex, one pill) too frequently (ex, per 36 hours).</p> <p>This standard caution, I believe is something these crooks do believing it may in fact relieve them from lawsuits generated by someone who suffers a heart attack, as I am not American, I do not know for sure.</p> <p>But I do know for sure that no herbal product contains that cautionary warning. As in the case of our product sold here in Canada for over 5 years and is suppled to the health clinic market as well as retail, you could eat every single pill all at once and the only difference you'd find is that you paid the same amount as someone taking only one dose.</p> <p>I see that cautionary warning on a lot of 'suspicious' US based product and often wonder why ordinary consumers don't.</p> <p>This is more than likely due to the amount of 'mininformation' that people are operating on, for example I often tell customers that the first mistake they committed when looking for these products, was actually looking for them.</p> <p>In Canada, NHP regulation weeds out these elements, not entirely, but certainly to the point where doing regular business is difficult and therefore, not worth attempting.</p> <p>But in the US this Natural Health Product regulation isn't there...leaving all Americans vulnerable to quack medicines.</p> <p>I remember having a conversation with a big player in Florida who is involved in the adult store industry.</p> <p>They were very interested in the work our company has done here in Canada and our formula. When I told him how much the raw cost of materials were in answering why I was quoting prices that he considered 'out to space'....he laughed at me and told me he could get generic viagra for pennies per pill and 'why would I spend that much on your product, when I'm going to throw it on 'lube gel bottles' as a sampler?'</p> <p>At that point I understood the problem and how deep it goes in the US.</p> <p>So take this advice.</p> <p>First and foremost, do not source out and buy product from 'websites'. This seems draconian but the truth is there is NO ONE with creditials or HONEST PASSION for herbal medicians that sells buy internet, all you'll find is people with HONEST PASSION to make a lot of money.</p> <p>Secondly, do not source out and buy product unless it comes recommended by a qualified ND (naturalpathic doctor).</p> <p>DO NOT trust your local health food store. There are no regulations in your country that force integrity on the store. There is no one government department licensing honest herbal manufacturing/distributors there fore there is no way for a health food store to make sure they are buying product from a legit honest dealer.</p> <p>And most important, look at the packaging. I've been studying pharmacology and natural products for 25 years and have always tried to maintain objectivity. My laboratory studies both complex dietary supplements and single agent drugs. If you read my blogposts over the last four years, you will know that I am equally critical of the pharmaceutical industry and the dietary supplement industry.</p> <p>My complaint about Stiff Nights containing undisclosed prescription drugs is two-fold: the primary one is that this adulteration can be extremely dangerous for certain people on anti-hypertensive medicines. It's not a simple matter of, "if you don't like it, don't use it," for those people. Second is that it also infringes on another company's intellectual property in a manner that is dishonest and deceptive. This whole FDA thing started because someone out there is counterfeiting our product. The FDA went in and tested counterfeit Stiff Nights and did find the active ingredient for Viagra in the pills. Since the release of their statement back in November we have been in FULL cooperation with the FDA and have invited them into our lab to test our product. As of the end of March 2010 the FDA gave us a green light to start manufacturing Stiff Nights again, which we have done. The future of Stiff Nights will be determined by the end of May 2010 when the owner of my company and the FDA have their meeting.</p> <p>Stiff Nights has been, and will remain 100% herbal. The counterfeiters have to put FDA regulated drugs into their product for it to work because they can't figure out our formula.
