Chemical facility safety
Starting in July 2015, the California Division of Occupational Safety and Health (Cal/OSHA) was authorized to hire several dozen more field compliance officers to protect the state’s 19 million workers. Because Cal/OSHA’s hiring has not filled all new positions or kept up with retirements, there has been an average of 34 vacancies of these fully-funded positions since then, resulting in $11 million in unused resources through August 2017. Not only is this a missed worker protection opportunity, no one knows what’s happened to these funds and where they are.

At PBS Newhour, Aubrey Aden-Buie reports on the shipbuilders that receive billions in federal contracts despite histories of serious safety lapses. In a review of federal contracts, Aden-Buie and colleagues found that since 2008, the federal government has awarded more than $100 billion to companies with records of safety incidents that injured and killed workers.

At the Center for Public Integrity, a five-part investigative series on safety at the nation’s nuclear facilities finds that workers can and do suffer serious injuries, yet the Department of Energy typically imposes only minimal fines for safety incidents and companies get to keep a majority of their profits, which does little to improve working conditions. Reporters estimated that the number of safety incidents has tripled since 2013.

Former Mayor Gayle McLaughlin remembers the phone calls from that evening. It was August 6, 2012. Constituents were calling McLaughlin at home to describe a huge cloud of black smoke infiltrated their neighborhoods. The cloud of pollution was coming from the Chevron refinery. A corroded pipe at the Chevron refinery failed, causing a massive cloud of hydrocarbon and steam that ignited.

On February 10th, California’s Department of Industrial Relations (DIR) proposed revised and stronger regulations for oil refineries in the state after a 4½-year joint campaign by labor unions, environmental and community organizations to protect both refinery workers and nearby communities. The regulatory proposal now goes to the state’s Occupational Safety and Health Standards Board for consideration and final approval.

At the Center for Public Integrity, Jim Morris reports on working conditions at the nation’s oil refineries, writing that more than 500 refinery incidents have been reported to the U.S. Environmental Protection Agency since 1994, calling into question the adequacy of EPA and federal labor rules designed to protect workers as well as the public. At KCRW (an NPR member station), Karen Foshay reports on occupational injuries among low-wage restaurant workers in California and the retaliatory barriers that often keep them from speaking up. She cited a 2011 Restaurant Opportunities Center survey of Los Angeles restaurant workers that found 42 percent experienced cuts, 43 percent experienced burns and more than half reported working while sick. At The New York Times, writers Kim Barker and Russ Buettner report on the labor investigations being conducted at nail salons throughout New York in the wake of a 2015 New York Times article that exposed widespread wage and labor abuses. They report that all but a dozen of the 230 salons whose investigations were closed last year were found violating at least one labor law. More than 40 percent of the salons were violating wage laws. A Republican-led plan to ban unions at the Internal Revenue Service could leave agency workers without union representation and make all federal unions susceptible to similar tactics, according to Joe Davidson writing in the Washington Post.

Last week OSHA announced citations and proposed a $99,000 penalty against DuPont for safety violations related to the November 2014 incident that killed four employees at its LaPorte, TX chemical plant. Wade Baker, 60, Gibby Tisnado, 48, Robert Tisnado, 39, and Crystal Wise, 53 were asphyxiated by methyl mercaptan because of gross failures in DuPont’s systems to manage highly hazardous chemicals. OSHA’s proposed penalty stems from one repeat, nine serious, and one other-than-serious violation.

An injured worker who was featured in the ProPublica/NPR investigation on the dismantling of the workers’ compensation system recently testified before lawmakers in Illinois, cautioning them against making the same drastic workers’ comp cuts as his home state of Oklahoma. Michael Grabell, who co-authored the original investigation, writes that John Coffell, who lost his home after hurting his back at an Oklahoma tire plant, was part of an eight-hour hearing on workers’ comp before the entire Illinois state assembly.
